TERMS AND CONDITIONS

Please read these Terms and Conditions carefully. By booking or using the services of Just A.S.K Courier Services, you agree to be bound by these Terms and Conditions.

1. Definitions

 

In these Terms and Conditions, the following words and phrases shall have the meanings set out below:

 

"Company," "We," "Us," "Our": Refers to Just A.S.K Courier Services, a courier service based in Buxton, Derbyshire, SK17 7LA.

 

"Customer," "You," "Your": Refers to the individual, firm, or company who contracts with the Company for the provision of services.

 

"Consignment": Refers to any item or items, including packaging, accepted by the Company for carriage from one address to another.

 

"Services": Refers to the courier and delivery services provided by the Company, including Same Day, Next Day, and 48-Hour (Economy) options.

 

"Pickup Point": The location where the Consignment is collected by the Company.

 

"Delivery Point": The location where the Consignment is delivered by the Company.

 

"Working Day": Monday to Friday 6:00am to 9:00pm, excluding public holidays in England.

 

"Dangerous Goods": Items that are hazardous or could pose a risk to health, safety, or property during transport, as defined by relevant UK and international regulations.

 

"Proof of Delivery (POD)": A signature, electronic confirmation, or photograph obtained from the Consignee acknowledging receipt of the Consignment.

2. Basis of Contract

 

2.1. These Terms and Conditions constitute the entire agreement between the Company and the Customer. They supersede any prior agreements, understandings, or arrangements, whether oral or written.

 

2.2. By requesting or booking Services, the Customer is deemed to have accepted these Terms and Conditions.

 

2.3. No variation to these Terms and Conditions shall be binding unless agreed in writing by a duly authorised representative of the Company.

 

2.4. The Company is not a common carrier and reserves the right to refuse to carry any Consignment or provide Services at its sole discretion, without providing a reason.

3. Services Provided & Delivery Times

 

3.1. The Company offers the following service levels:

 

* **Same Day Delivery (Premium):** Dedicated van service for urgent consignments, collected immediately and delivered directly. Estimated delivery times are provided at the time of booking and are dependent on distance, traffic, and time of day.

 

* **Next Day Delivery:** Consignments collected today for delivery by the end of the next Working Day. This service allows for optimised routing but remains a priority service.

 

* **48-Hour Delivery (Economy):** Consignments collected for delivery within two Working Days (48 hours). This is the most economical option, allowing for multi-drop routing and consolidation.

3.2. All delivery times provided are estimates only and are not guaranteed unless explicitly agreed in writing as a "Guaranteed Timed Delivery" with an applicable surcharge. The Company shall not be liable for any loss or damage arising from delays in delivery unless a specific guarantee was made and breached.

 

3.3. For long-distance journeys requiring an overnight stay due to driver hour regulations, the delivery timeframe will extend to the next Working Day or beyond, as communicated at the time of booking. The van will be off the road between 9:00 PM and 6:00 AM.

4. Customer's Obligations

 

4.1. The Customer warrants that: * They are the owner of the Consignment or are authorised by the owner to accept these Terms and Conditions on their behalf. * The Consignment is properly and sufficiently prepared, packed, stowed, labelled, and/or marked for safe transport, considering its nature and any specific handling requirements. * All information provided regarding the Consignment (e.g., weight, dimensions, contents, value, special handling instructions) is accurate and complete. * The Consignment does not contain any Dangerous Goods or prohibited items unless explicitly declared and agreed upon by the Company in writing prior to collection. * They will provide safe and clear access for collection and delivery, and adequate assistance for loading/unloading if required due to the size or weight of the Consignment.

 

4.2. The Customer shall indemnify the Company against all losses, damages, claims, costs, and expenses arising from any breach of the warranties in Clause 4.1.

5. Charges and Payment

 

5.1. All charges for Services will be quoted based on distance, weight, chosen service level, and any applicable surcharges (e.g., minimum pickup fee, overnight accommodation, waiting time, out-of-hours, congestion charges, tolls).

 

5.2. A minimum pickup fee of £65.00 applies to all bookings.

 

5.3. Overnight Accommodation: A charge of £110.00 per night will be applied for journeys requiring an overnight stop due to distance or driver hour regulations. This charge includes the driver's accommodation, food and drink.

 

5.4. Waiting Time: A grace period of 15 minutes for loading/unloading is provided at both the Pickup Point and Delivery Point. Thereafter, a waiting charge of £40.00 per hour (charged in 15-minute increments) will apply.

 

5.5. Out-of-Hours / Weekend / Bank Holiday Surcharge: A surcharge of 25% will be applied to the total delivery fee for collections or deliveries requested outside standard Working Day hours (6:00 AM - 9:00 PM) or on weekends/bank holidays (unless agreed in advance).

 

5.6. London Congestion Charge / ULEZ / Tolls: Any applicable congestion charges, Ultra Low Emission Zone (ULEZ) charges, or road tolls will be added to the invoice at cost.

 

5.7. Payment Terms: * For new Customers or one-off bookings, full payment may be required upfront or upon collection. * For approved account Customers, invoices are due for payment within 7 days from the invoice date. * The Company reserves the right to charge statutory interest on overdue payments at 8% above the Bank of England base rate, plus compensation for debt recovery costs, as per the Late Payment of Commercial Debts (Interest) Act 1998.

6. Cancellations and Failed Collections/Deliveries

 

6.1. Customer Cancellation: * If a booking is cancelled with more than 24 hours' notice before the scheduled collection time: No charge. * If a booking is cancelled with 4 to 24 hours' notice before the scheduled collection time: 50% of the minimum pickup fee will be charged. * If a booking is cancelled with less than 4 hours' notice before the scheduled collection time, or after the van has been dispatched: The full minimum pickup fee (£65.00) plus any incurred mileage charges will be applied.

 

6.2. Failed Collection/Delivery: * If the Company is unable to collect the Consignment due to Customer fault (e.g., goods not ready, incorrect address, no access), a failed collection fee equivalent to the minimum pickup fee (£65.00) plus any incurred mileage will be charged. * If the Company is unable to deliver the Consignment due to Consignee fault (e.g., recipient unavailable, incorrect address, no access), a failed delivery fee equivalent to the minimum pickup fee (£65.00) or 50% of the total quote (whichever is greater) will be charged. The Customer will also be responsible for costs associated with redelivery or return of the Consignment.

7. Liability and Insurance

 

7.1. The Company shall exercise reasonable care and skill in providing the Services.

 

7.2. Goods in Transit Insurance: The Company maintains Goods in Transit insurance for Consignments up to a maximum value of £15,000 per Consignment. This cover is subject to the terms and conditions of the Company's insurance policy.

 

7.3. Limitation of Liability: * The Company's liability for loss, damage, or mis-delivery of a Consignment is limited to the lesser of: * The actual value of the Consignment (or part thereof) lost, damaged, or mis-delivered; or * The maximum value covered by the Company's Goods in Transit insurance policy as stated in Clause 7.2. * The Company shall not be liable for any indirect, special, or consequential loss or damage, including (but not limited to) loss of profit, loss of business, loss of revenue, loss of anticipated savings, or loss of goodwill, even if advised of the possibility of such loss or damage. * The Company shall not be liable for loss or damage to Consignments that are: * Insufficiently or improperly packed. * Prohibited items or Dangerous Goods not declared and agreed upon in writing. * Fragile items (e.g., glass, ceramics, liquids) unless specifically agreed in writing that they are suitable for transport and appropriate packaging is used. * Items with inherent defects or deterioration.

 

7.4. Claims for Loss or Damage: * Any claim for loss, damage, or mis-delivery must be notified to the Company in writing within 2 Working Days of the delivery date (or expected delivery date in case of total loss). * A full claim, including supporting documentation (e.g., proof of value, photographs of damage), must be submitted in writing within

 

7 Working Days of the initial notification. * Failure to adhere to these time limits may result in the claim being rejected.

 

7.5. Force Majeure: The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond its reasonable control, including (but not limited to) acts of God, war, civil unrest, strikes, industrial action, severe weather, traffic incidents, road closures, or governmental actions.

8. General

 

8.1. Subcontracting: The Company reserves the right to subcontract any part of the Services to a third party. The Customer's rights under these Terms and Conditions will not be affected, and any subcontractor shall have no greater liability to the Customer than the Company.

 

8.2. Proof of Delivery: The Company will take reasonable steps to obtain a Proof of Delivery. This POD shall be conclusive evidence that the Consignment was delivered complete and in good order, unless otherwise marked by the Consignee at the time of delivery.

 

8.3. Data Protection: The Company will process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy, available on our website, provides further details.

 

8.4. Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
